There is nothing that can be done he did nothing "illegal" He had the correct login information when logging into everything, "NOT 1 FAILED LOGIN ATTEMPT" might i add. This is why it went un-noticed till i started searching for a problem. If he had done something wrong i would have reported it already, No doubt crippling 2 VPS's is wrong but he didn't do anything wrong to obtain information to either VPS.
I want all of you to note that only 2 VPS's were crippled by this person, Its not some HUGE hacker. And like i stated earlier he knew both the clients before hand which helps me prove the point it had nothing to do with us. And the fact he never failed a login completely proves it has nothing to do with us.
I should like to point out that unauthorized access access of a computer from a remote location and theft of intellectual properties is indeed hacking.
Hack: To gain access to (a computer file or network) illegally or without authorization:
hacked the firm's personnel database.
Here is an excerpt from the Computer Missuse Act of 1990
"Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—
Computer misuse offences
1 Unauthorised access to computer material (1) A person is guilty of an offence if—
(a) he causes a computer to perform any function with intent to secure access to any program or data held in any computer;
(b) the access he intends to secure is unauthorised; and
(c) he knows at the time when he causes the computer to perform the function that that is the case.
(2) The intent a person has to have to commit an offence under this section need not be directed at—
(a) any particular program or data;
(b) a program or data of any particular kind; or
(c) a program or data held in any particular computer.
(3) A person guilty of an offence under this section shall be liable on summary conviction to imprisonment for a term not exceeding six months or to a fine not exceeding level 5 on the standard scale or to both."
